Terms of Use

Plain language summary: Use the app honestly, understand its limitations, and know that subscriptions are handled by Apple. Dutch law applies.

1. Acceptance

By downloading or using PinX Golf ("the App"), you agree to these Terms of Use. If you do not agree, please do not use the App. The App is developed and operated by Donald van Pinxteren, Netherlands ("we", "us", "developer").

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on any iPhone you own or control, subject to these terms and the Apple App Store Terms of Service. You may not:

The App is free to download and includes a permanent free tier. Additional features are available through a Pro subscription:

All subscriptions are billed through the Apple App Store. Apple acts as the merchant of record. By subscribing, you also agree to Apple's media services terms. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Manage or cancel your subscription at any time in your iPhone's Settings → Apple ID → Subscriptions.

We reserve the right to change subscription pricing. If we do, we will notify existing subscribers through the App Store in advance of any price change taking effect.

4. Handicap calculations

PinX Golf calculates a Handicap Index using the World Handicap System (WHS) formula for personal tracking and informational purposes only. This calculation is not affiliated with, endorsed by, or submitted to the USGA, R&A, or any national golf federation.

The Handicap Index shown in PinX Golf is not an official handicap and cannot be used for competition entry, handicap verification, or any official purpose. For an official handicap, register with your national golf federation through an affiliated club.

5. GPS accuracy

Live GPS distances depend on your device's GPS hardware, your location, and environmental conditions. We provide no warranty as to the accuracy of distances shown. Do not rely on PinX Golf distances for any purpose where precision is safety-critical. GPS data should be used as a guide only — always apply your own judgement on the course.

6. Data and backups

All your data is stored locally on your device. We strongly recommend using the Data Export feature (Settings → Data → Export JSON) to maintain your own backups. We are not responsible for data loss resulting from device failure, accidental deletion, or app removal.

7. Disclaimer of warranties

The App is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that any defect will be corrected. To the maximum extent permitted by Dutch law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.

8. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to decisions made on the basis of stat data, GPS distances, or handicap calculations shown in the App.

Our total liability to you for any claim arising from these terms or your use of the App shall not exceed the amount you paid for a Pro subscription in the twelve months preceding the claim.

9. Changes to the App and terms

We may update the App and these Terms at any time. Material changes to these Terms will be communicated through an app update or in-app notice. Continued use of the App after such changes constitutes your acceptance of the updated Terms.

10. Termination

We may suspend or terminate your access to the App at our discretion if you breach these Terms. Upon termination, the licence granted to you ends immediately. Provisions that by their nature should survive termination (including sections 7 and 8) will do so.

11. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any dispute arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands, without prejudice to your rights as a consumer under applicable mandatory EU consumer protection law.
